Check this out: HB 109 not only requires all operators of a motorcycle in Louisiana to wear a helmet.  It also removes the following paragraph from Louisiana State Revised Statute RS 32:109 ("Helmet Law").

RS 32:109 A.(3) The Louisiana Highway Safety Commission shall collect and compile statistical information on the number of fatalities and injuries incurred in crashes which involve motorcycles. The Louisiana Highway Safety Commission shall report such information annually, prior to the beginning of each legislative session, to the House and Senate Committees on Transportation, Highways and Public Works.

I wonder why this paragraph should be removed?

Ask Ms Baudoin , Senator Chaisson  and Governor Blanco how removing this paragraph will prevent head injuries to motorcyclist's.

The Louisiana Highway Safety Commission, LHSC, may not be able to comply with this paragraph.  Is this the reason for all the Bull S*** involved in passing this bill?

For this Legislative session of 2004 ending June 21, 2004  LHSC has not complied with RS 32:109 A.(3). 

The last actual report they have documented is a report by Helmut Scheinder "An Analysis of Motorcycle Crashes 1996-2002; May 3, 2003".  This report does not support claims presented by the proponents of HB109.  

LHSC has published a table for 2003 that has a footnote stating 2003 figures were estimated.  This "estimated" table is identical to a table from the Helmut Shceinder report from 2002 (The "estimated" 2003 LHSC table does not credit the 2002 Scheinder report, plagiarism perhaps?). 

 Louisiana  R.S. 32:109 requires LHSC to report annual statistics to the transportation committees in the Senate and House.  The report must be presented BEFORE the legislative session begins (use of estimates are not mentioned as acceptable).  The 2004 Legislative Session is now over.  The LHSC report for 2003 has not yet been published. 

Q: How could our legislators fairly consider these bills without having current information as required by law? 

A: They could not?

Q: How did our legislators pass these bills without the current information as required by law?

A: With deception and manipulation of the legislative process?

Q: Do they not know the State of Louisiana violated the "helmet law", RS 32:109 ? 

A: They do? If they don't shame on them!

Q: Why would the Governor and other proponents of the Bill want this paragraph removed?

A: So they don't have to defend themselves against statistics that do not support their lies?

Q: Is this paragraph being removed so proponents of this bill will not have to deal with state provided documentation showing they are wrong?

A: Yes?

Q: Did the state of Louisiana and the LHSC violate the "Helmet Law", RS 32:109? 

A: Yes?

Q: Why pass more Laws or Regulations when the state does not/can not enforce existing ones?

A:      1.  Because they can? .   

      2.  Because of  personal vendetta / egos?

3.  So Louisiana will remain known as a State with an Executive Branch and Legislative Branch that can be bought?

4.  The more laws and regulations the more chance the State has to collect revenues from violatiors?

 

Perhaps there should have been more of an outcry about HB 109 removing this paragraph R32.109 A (3) from the existing RS 32.109 "Helmet Law". 

 

Regardless,   It appears the State of Louisiana has violated  RS. 32.109 as it is currently written.

WHO GETS FINED WHEN THE STATE VIOLATES ITS OWN LAWS?

WHY SHOULD THE CITIZENS HAVE TO ABIDE BY A LAW THAT THE STATE ITSELF DOES NOT ABIDE BY?

WHY PASS NEW LAWS WHEN THE STATE DOES NOT ENFORCE THE EXISTING ONES?
